Womack Phelps Puryear Mayfield & McNeil OBTAINS DISMISSAL OF VEIL PIERCING CASE

Womack Phelps Puryear Mayfield & McNeil successfully defended their clients in the case of Fulmer et al. v. Hurt et al. before the Arkansas Court of Appeals. The plaintiffs obtained a judgment against a limited liability company in another suit and then sought to enforce the judgment against the members of the LLC. The plaintiffs’ effort to pierce the veil of the LLC to force the individual members to pay for the judgment was dismissed on summary judgment grounds. The Arkansas Court of Appeals unanimously affirmed the judgment in favor of the defendants in an opinion delivered on March 1, 2017. The Court maintained that a plaintiff in a veil piercing effort must demonstrate fraud, illegal conduct or abuse of an entity for the specific purpose of injuring a party.
